By purchasing a ticket and/or attending any Dark Flame Society event (“Event”), you (“Attendee”) agree to the following terms and conditions:
1. Ticket Sales & Refund Policy
All sales are final. No refunds, exchanges, or transfers will be issued under any circumstances, including but not limited to illness, scheduling conflicts, weather conditions, or transportation issues.
If you purchase a Ticket Protection Plan through TicketSpice or any third-party vendor, please note that Dark Flame Society is not affiliated with, responsible for, or involved in any claims, refunds, or reimbursements related to that plan.
Lost, stolen, or counterfeit tickets will not be honored.
2. Assumption of Risk & Liability Waiver
Attendance and participation are at your own risk.
Dark Flame Society, its owners, affiliates, staff, vendors, volunteers, performers, and venue partners (“Released Parties”) are not liable for any personal injury, illness (including COVID-19 or other communicable diseases), property damage, loss, theft, or death that may occur before, during, or after the Event.
By attending, you voluntarily assume all risks associated with attendance, including but not limited to exposure to fog, strobe lights, loud sounds, flashing lights, uneven terrain, or any potentially hazardous environmental or visual effects used during the Event.
3. Personal Property
Dark Flame Society is not responsible or liable for any lost, stolen, or damaged personal items. Please keep your belongings secure at all times.
4. Substance Use, Intoxication & Illegal Activity
Illegal substances of any kind are strictly prohibited. Any attendee found in possession of, using, or distributing illegal drugs will be immediately reported to local law enforcement, and appropriate legal action will be taken.
Excessive intoxication that poses a risk to the attendee, others, or event property will result in the attendee being denied entry or removed from the premises without refund or reimbursement.
Dark Flame Society and venue staff reserve the right to determine what constitutes excessive intoxication or disruptive behavior.
Any attendee engaging in illegal, unsafe, or inappropriate behavior may be escorted out and permanently banned from future events.
5. Photography, Video, and Media Release
By entering the Event premises, you grant Dark Flame Society and its authorized agents the irrevocable right and permission to photograph, record, or otherwise capture your image, likeness, and/or voice in any media now known or later developed.
You also grant the unrestricted right to use, reproduce, distribute, and display such materials for any lawful purpose, including promotional or advertising purposes, without compensation or further approval.
6. Code of Conduct & Removal Policy
Attendees are expected to behave respectfully toward others, staff, and property. Harassment, violence, discrimination, vandalism, or any form of disorderly conduct will result in immediate removal without refund.
Dark Flame Society reserves the right to deny entry, remove, or ban any individual whose behavior compromises the safety, comfort, or experience of others.
7. Force Majeure
Dark Flame Society shall not be held responsible or liable for any delay, cancellation, or modification of the Event due to causes beyond its control, including but not limited to natural disasters, government restrictions, public health emergencies, labor disputes, acts of God, or unforeseen circumstances. In such cases, no refunds or credits will be issued.
8. Indemnification
You agree to indemnify, defend, and hold harmless Dark Flame Society and all Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to your attendance or participation in the Event.
9. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the appropriate courts of [County], Missouri.
By purchasing a ticket, you acknowledge that you have read, understood, and agreed to these terms in full.
